General rental conditions
Article 1: object
The purpose of this document is to set out the terms and conditions for renting bicycles offered by La Cyclerie.
In the rest of the document, the subscriber to the contract will be referred to as “the user”
Article 2 – Bicycle user
The user of the bicycle declares that he is suitable for cycling and is not aware of any medical contraindications.
Minors must provide authorization signed by their legal representative allowing them to sign a rental contract.
The rental company cannot be held responsible for damages caused by the user’s incapacity.
Bicycles, equipment and accessories are deemed to comply with the regulations in force at the time of their rental and in good working order. Equipment and accessories are fixed according to safety standards. The user must be covered by civil liability insurance. It releases the rental company La Cyclerie from any liability arising from the use of the rented equipment, in particular with regard to accidents and damage caused to third parties due to the use of the bicycle. The rented equipment remains the exclusive property of La Cyclerie for the entire duration of the loan. The user cannot sublet them to a third party. The user is solely responsible for any damage caused to the rented equipment or due to its use. The user acknowledges that the equipment loaned is in perfect working order. The user undertakes to use the equipment with care and within the limits of his abilities, to respect the instructions for use and safety which will be transmitted to him by the rental company, to use the loaned bicycle under its normal conditions and not to Do not carry a person or a load weighing more than 25 kilos on the luggage rack. He undertakes to return the bicycle in its original condition on the dates agreed in the contract. The user declares to comply with these highway code regulations. If it contravenes the laws and regulations in force during the rental, the rental company La Cyclerie cannot under any circumstances be held responsible. The user undertakes to do everything possible to avoid theft or damage to the rented bicycle. For this purpose, whatever the duration of the bicycle parking, it must be attached to a fixed point using the anti-theft device provided. In the event of a technical failure of the bicycle during the contract, the user cannot undertake repair work on his own initiative. He is required to inform the rental company and return the rented bike if possible. At his request, the bicycle will be replaced by a bicycle of the same type, subject to availability and in the absence of culpable liability on the part of the user, for the remaining period. The user will not be able to claim reimbursement of costs or invoices, nor damages.
Any aggressive, disrespectful behavior or refusal to respect these regulations will result in the rental being refused.
Article 4 – Subscription to the contract and rental terms
– In order to sign a rental contract, the user must present proof of identity (ID card, driving license, passport)
– Rental duration, extension, termination:
Any rental, regardless of the duration chosen when taking out the contract, is due in full. When returning the bike, the user must come no later than 10 minutes before the rental service closes. He can then, if he wishes, renew or extend his rental. In the event of renewal, the user must present the rented bike. For the 2 to 5 hour or day formula, the bike must be returned on the same day of its rental.
– Prices and payment terms:
Rental rates, deposits and payment terms are displayed. The prices invoiced are those in effect on the day of rental, the rental company reserving the right to modify its prices at any time. In this case, the user will be informed at least one month in advance by posting. The new rates will only be applied when the user begins a new rental period. The user is required to pay for their first rental period on the day the rental begins. If the user wishes to renew their contract, the second rental periods must be paid before they come into force. The means of payment accepted by La Cyclerie are credit card, cash, checks and ANCV holiday vouchers.
The rented bike must be returned no later than the day indicated on the rental contract. The deposit will be returned to the user upon return of the rented equipment. The user may, however, extend his rental in view of the current rates. In the event of theft, the user must provide proof to the rental company, within 24 hours of the theft, of filing a complaint within 24 hours with a police or gendarmerie station. A certificate of collection may be provided upon request if the user wishes to have the deposit reimbursed by their insurance. If the stolen bicycle is returned to the rental company, the user who has complied with the above procedure will be reimbursed the amount of the deposit collected, less any costs of repairing the bicycle (see article 7). If the user does not justify filing a complaint, payment of the value of the new bicycle will be due immediately. In the event of non-payment of the cost of rental of the equipment or the repair costs or its reimbursement, at the end of the contract, the customer, by providing his bank card information, authorizes and gives express mandate to the store to deduct from its bank account the sums which will remain due, in accordance with the estimate (rental contract) which it itself will have signed when picking up the equipment and/or the price and conditions displayed in the store.
Article 7 – Billing to the user
In the event of non-compliance with the previous clauses of the rental contract, or in the event of damage to the rented equipment, the user will have to pay the following invoices:
– Invoice for the market value of the bicycle, in the event of failure to return the bicycle.
Value of the material in the event of non-return:
Classic bike: 250 euros. VTC, mountain bike, beach cruiser: 350 euros. Trailer: 200 euros. Child seat: 80 euros. Electric bike and Tandem: 1200 euros. Electric fatbike and VTTAE: 2000 euros. Children’s mountain bike and crasy bike: 250 euros. Children’s bike without gear 100€
– Invoice for an amount equivalent to the corresponding repair invoice, in the case of repairs resulting from damage or missing parts.
A receipt will be given to the user upon request, once payment has been received.
Article 8 – Times and location
The opening hours will be those of the store, available online or on site.
Article 9 – Information technology and freedoms
